By logging into your Seleqt account you agree to be bound by our Terms & Conditions. Last updated on 21 January 2025.

These General Terms of Service ("Terms") are a legally binding agreement between Seleqt ("Seleqt") and the subscribing party ("Partner"). These Terms govern your access to and use of Seleqt’s lead generation software platform and related services (collectively, the "Service").


Please read these Terms carefully. By subscribing, accessing, or using the Service, you agree to abide by the most current version of these Terms.


1. Definitions


  • Assistance Services: Any consulting, onboarding, and training provided to facilitate Partner’s use of the Service.

  • Partner Data: Data, including personal information, collected, processed, or managed by the Partner within the Service.

  • Service: The automated lead generation platform provided by Seleqt, which includes various lead generation and communication functionalities.

  • Intellectual Property Rights: All rights related to patents, trademarks, copyrights, software, and other proprietary information.

  • Operating Policies: The privacy and acceptable use policies governing the Service.

  • Specific Terms: Any agreed-upon terms specific to Partner, including pricing and feature arrangements.


2. Modifications to Terms


Seleqt reserves the right to update or change these Terms at its sole discretion, with at least 30 days' notice before any updates become effective.


3. Service Usage and Access


3.1 Service Offering and Permitted Use


Seleqt provides access to its lead generation platform as detailed on our website. Access and usage are governed by these Terms, and it is the Partner’s responsibility to ensure that all authorized users comply. The Service may not be disrupted, interfered with, or used outside the agreed terms. Seleqt reserves the right to suspend or terminate accounts if users do not comply with the terms mentioned.


Each subscription plan allows for a specific maximum number of sending accounts, based on the subscription chosen by the user. A sending account can either represent a connected LinkedIn account or an email account, and users have the flexibility to select the type of account they wish to connect.


For LinkedIn accounts, there are predefined limits on activities such as sending invites, InMails, messages, likes, and profile visits. These limits are determined by LinkedIn's policies and the user’s LinkedIn subscription level. Users are required to adhere strictly to these limits and may not attempt to bypass them as specified within the Seleqt application.


Similarly, email accounts have daily sending limits, which are clearly outlined in the Seleqt application. Users must comply with these restrictions to ensure proper functioning and adherence to applicable policies.


Connecting multiple sender accounts without having the necessary subscription (paid for each account), or transferring accounts without prior notice to Seleqt (via info@seleqt.ai), is prohibited. Seleqt reserves the right to disconnect LinkedIn or email accounts that exceed seat limitations.


3.2 Support


Seleqt offers Customer Support to Partners via email on weekdays from 9:00 to 17:00 (CET), excluding Dutch holidays. Partner may initiate a helpdesk ticket any time by emailing info@seleqt.ai. Seleqt will use commercially reasonable efforts to respond to all Helpdesk tickets within five (5) business days.‍‍


3.3 Credentials and Authorized Access


Partners are required to provide accurate information upon account creation, including full name, business name, address, and contact information. This data will be managed per our Privacy Policy, which outlines data handling practices for Service provision.


Partners must safeguard account credentials and promptly notify Seleqt of any unauthorized use. Each account is strictly for the Partner’s use and any authorized users, and Seleqt may request proof of identity as necessary. Unauthorized account activity is the responsibility of the Partner, who will indemnify Seleqt for any related claims.


3.4 Content Responsibility


The Partner is solely responsible for all content (Data) shared or transmitted through the Service, ensuring that all content adheres to applicable regulations. The following are expressly prohibited:

  1. Content that infringes on third-party intellectual property rights.

  2. Malicious software, viruses, or other damaging code.

  3. Material that is unlawful, harassing, or otherwise inappropriate.

  4. Sensitive personal information, including financial or health data.

  5. Misleading, false, or inaccurate content.

  6. Content violating Seleqt’s Operating Policies.


Seleqt reserves the right to monitor and remove content as required to prevent illegal activities. Seleqt assumes no liability for any content loss, and Partners are encouraged to maintain backups.


3.5 Sending and Usage Policy


Partners agree to abide by Seleqt’s usage policies, which include the following actions according to their Linkedin plan:


  • Normal: Connection Requests: 25/day, Messages 50/day.

  • Recruiter Lite: Connection Requests: 60/day, Messages 80/day, Inmails 100/day.

  • Recruiter Seat: Connection Requests: 60/day, Messages 80/day, Inmails 100/day.

  • Sales Navigator: Connection Requests: 60/day, Messages 80/day, Inmails 100/day.

  • Emails: 50/day


Seleqt may temporarily limit outreach if policy breaches are detected, with no refunds issued for restricted access. Partners remain responsible for all fees during such limitations.


4. Plans and Financial Terms


4.1 Plans


Seleqt offers three plans on our website:


  • “Trial Month" which is billed at €29 for the first month

  • "Growth Plan" which is billed at €69/month

  • “Agency” for more than 20 sending accounts and billed as per agreement


Only one Trial Month is allowed per business entity, and you may at any time terminate your free plan or upgrade to a paid plan.

Partners can add additional email sending accounts for €9.00 per account and additional LinkedIn account for €29.00 per account. Partners can on a monthly basis decide to upgrade or downgrade the number of sending accounts.

Paid plans are based on a monthly payment basis without any fixed-term commitment. Your paid subscription shall be due and payable on a monthly basis in advance from the date of your first paid subscription and will be automatically renewed thereafter on the same basis. You can cancel the paid plan monthly, but it has to be at least a one-day notice cancellation before the payment for the next term month, otherwise Seleqt will still charge for the remaining month. It is then your responsibility to anticipate the termination of Your plan to make it effective at the most convenient time.


Payment may be made by:

  • automatic debit upon paid-plan's subscription and at each renewal

  • bank transfer to the coordinates indicated on Seleqt’s invoices

  • credit card through the secure online payment service specified on the Website.


Payment is processed through the payment service provider Stripe.


You warrant to Seleqt that you have the necessary authorizations to use the chosen payment method. You authorize Seleqt to charge the payment you provide to us for any and all costs and amounts that you owe us for the Services.


4.2 Trial Month


Seleqt offers Partners the ability to participate in a Trial Month. This program has a duration of 30 days, gives the users unlimited functionality, and is charged with €19.00. All terms in this agreement are also subject to the pilot program.


After the 30-day period, Seleqt will contact the Partner and ask if they are interested in continuing with the product using the "Growth Plan" mentioned in 4.1. If this is not the case, Seleqt will terminate the account of the Partner.


4.3 Common provisions for all paid plans


Any delay in payment (i) will allow Seleqt to recover and without notice late interest, any collection fees, and other amounts as allowed by law and (ii) may immediately, after notice, temporarily suspend access to and use of the service and/or terminate your subscription. All amounts payable are quoted excluding taxes. Partners shall pay any and all taxes imposed by any government on the amounts payable for the Services, or reimburse Seleqt in the event Seleqt has paid such amounts, for which the Partner is personally responsible.


Seleqt reserves the right to change the services’ fees by notifying you by email with at least a thirty (30) day notice. If you do not accept the new fees as notified to you, you shall cease all use of the services on or before the last day of the monthly period already paid at the date of the notification and terminate your plan. For fixed-term agreements, the fees applicable are the ones in force on the date of your order; the new fees will be applicable to you only on the expiration of your fixed-term agreement.


Seleqt has the ability to terminate the contracts at any time - users will be reimbursed with the money that they have paid for that month.


Seleqt is not liable for issuing a refund if the Partner fails to cancel their account in accordance with our required 1-day notice prior to the start of a new month.


5. Termination


5.1 Right of Withdrawal


The Services are reserved exclusively for professional use, and any regulations on consumer or retraction rights are not applicable to the Services.


5.2 Termination and/or deletion of an account upon Seleqt’s initiative


Seleqt may terminate your Account and the performance of Services at its sole discretion under the following circumstances:


  • At any time and for any legitimate reason for each plan provided reasonable notice is given

  • After the Partner has been notified by Seleqt following any breach of laws or regulations or these Terms, including but not limited to: if payment or partial payment of any sum due by the Partner is not received by Seleqt; in the event of a payment incident; in the event of a breach or attempted breach of the Website security; or, in the event of fraud or attempted fraud when using the Application.



5.3 Consequences of the Termination


Upon expiration or termination of your account for any reason whatsoever, all amounts still owed by you shall become due and payable immediately. Seleqt will not refund any prepaid fees and will charge the Partner the full amount that Seleqt would have been entitled to charge for the remaining term.


Partners are advised that as of the effective termination date of their account, they will cease to have access to their account and to the Data stored therein, subject to the provisions of the Privacy Policy and applicable laws.


6. Intellectual Property


6.1 Service Ownership


Seleqt retains all intellectual property rights to the Service, including software, design, algorithms, and any associated materials. This ownership extends to any updates, modifications, or enhancements made to the Service.


6.2 License Scope and Duration


Partner is granted a limited, non-transferable, non-exclusive right to access and use the Service solely for authorized purposes during the term of the agreement. Any rights not expressly granted herein are reserved by Seleqt.


6.3 Partner Data Ownership


Partner retains ownership of all data submitted to the Service. Seleqt’s use of this data is limited to providing and improving the Service in accordance with applicable data protection laws.


6.4 Intellectual Property Protection


Partner agrees not to infringe upon Seleqt’s intellectual property rights in any way, including unauthorized use, distribution, or copying of any elements of the Service.


7. Restrictions and Prohibited Activities


7.1 Unauthorized Access and Use


Partner agrees not to access or attempt to access parts of the Service outside their authorized scope, including attempting to bypass any security measures or access controls.


7.2 Prohibited Data Use


Partner shall not use the Service to store or transmit any harmful, obscene, or infringing content. Additionally, Partner agrees not to upload or introduce any viruses, malware, or harmful code into the Service.


7.3 Automated Data Collection


Partner shall not use automated scripts, bots, scraping, or similar tools to collect data from the Service, unless explicitly authorized by Seleqt.


7.4 Limitations on Sub-Licensing


Partner may not assign, sublicense, or otherwise transfer their rights to access the Service, unless explicitly permitted by Seleqt in writing.


7.5 Competitive Restrictions


Partner shall not use the Service to develop or assist in the development of any competing product or service or to gather competitive intelligence.


7.6 Compliance with Policies


Partner agrees to comply with any usage policies, code of conduct, or community guidelines established by Seleqt to ensure a secure and compliant environment for all users.


8. Service Level Agreement (SLA)


8.1 Service Availability


Seleqt will use commercially reasonable efforts to ensure that the Service is available 99% of the time, excluding scheduled maintenance, Force Majeure events, or issues arising from Partner’s systems or third-party providers. Availability is measured monthly as the total time the Service is operational divided by the total time in the month, minus excluded downtime.


8.2 Scheduled Maintenance


Seleqt reserves the right to conduct maintenance on the Service to ensure optimal performance. Scheduled maintenance will generally be performed during low-usage hours and will be announced to Partners at least 48 hours in advance. During maintenance periods, the Service may be temporarily unavailable.


8.3 Incident Response Time


Seleqt is committed to addressing incidents promptly:

  • Critical issues (e.g., complete Service outage): Initial response within 4 business hours.

  • Major issues (e.g., severe degradation of functionality): Initial response within 1 business day.

  • Minor issues (e.g., minor bugs or non-critical functionality issues): Initial response within 5 business days.


Seleqt will use commercially reasonable efforts to resolve incidents as quickly as possible, prioritizing critical and major issues.


8.4 Partner Responsibilities


The Partner must notify Seleqt promptly of any Service issues by submitting a ticket to info@seleqt.ai, providing clear details about the issue and any steps taken to reproduce it.


8.5 Exclusions


Seleqt is not responsible for Service unavailability or performance issues caused by:

  • Third-party services, including LinkedIn, internet providers, or email services.

  • Partner’s hardware, software, or network issues.

  • Use of the Service in a manner inconsistent with these Terms or the Operating Policies.

  • Force Majeure events, including but not limited to natural disasters, cyberattacks, or governmental actions.


8.6 Service Credits


If Seleqt fails to meet the Service availability commitment in Section 8.1 in any given month, the Partner may request a Service credit, which is a discount on the subscription. Service credits will be calculated as 5% of the monthly subscription fee for every 1% below 99% availability, up to a maximum of 50% of the monthly subscription fee.


To request a credit, the Partner must submit a claim to info@seleqt.ai within 10 business days after the end of the affected month.


Service credits are the sole and exclusive remedy for any failure to meet the Service availability commitment and will be applied as a discount on future invoices.


8.7 No Warrenties Beyond SLA


This SLA outlines Seleqt’s sole obligations concerning Service performance and availability. Seleqt disclaims any additional warranties, whether express or implied, related to the Service’s uptime or reliability.


9. Privacy and Data Usage


As per our Privacy Policy, Seleqt is committed to protecting and respecting Partner data, which is handled in compliance with relevant data protection laws. Partners are encouraged to review the Privacy Policy to understand how their data is used and safeguarded.


10. Warranties and Disclaimers


Seleqt aims to provide a functional Service that aligns with its documentation, though it does not guarantee an entirely error-free or bug-free experience. Should a Partner identify any compliance issues, they must promptly notify Seleqt, which will make reasonable efforts to resolve the matter as soon as possible. Partners acknowledge that Seleqt cannot control internet data transfer and, therefore, is not responsible for any delays or connectivity issues arising from external network disruptions.


While Seleqt strives for consistent Service availability, uninterrupted access cannot be guaranteed. The Service is offered “as-is” and “as-available,” with no express or implied warranties, and Seleqt disclaims any responsibility for the accuracy, reliability, or completeness of candidate data.


11. Limitations of Liability


Seleqt and its Website may include links to external websites or resources. As Seleqt does not control these sites, Seleqt cannot be held responsible for their availability, content, advertising, products, services, or materials. Links are provided for convenience only and do not imply endorsement of any site or content. Additionally, Seleqt is not responsible for the actions of other users or for any damages or losses arising from accessing or relying on content, products, or services on external sites.


In case of Force Majeure, Seleqt’s obligations to perform the Services are suspended as defined in these Terms. Seleqt may also temporarily suspend access to the Services for maintenance, in which case Seleqt will endeavor to provide notice and minimize downtime.


Seleqt is not liable for any account suspensions of third parties (like Linkedin or email) or penalties incurred. Partners are responsible for maintaining compliance with account providers’ terms and for all actions taken under their account.


Seleqt, including its suppliers, employees, and representatives, are not liable for any indirect or consequential damages, such as lost revenue, profits, business interruptions, or data loss. In the event of any Partner or End User's non-compliance with Seleqt's policies, Seleqt holds no liability, especially in cases of temporary or permanent Service suspension.


Seleqt’s total liability is limited to the amount the Partner paid, if any, for use of the Website and Services in the twelve (12) months prior to the incident.


By subscribing, the Partner acknowledges understanding the associated risks and agrees to the pricing based on this risk allocation, which is fundamental to the agreement’s balance.


12. Miscellaneous


These Legal Terms, along with any policies or rules posted in connection with the Services, constitute the entire agreement between Seleqt and the Partner. If Seleqt does not exercise or enforce any provision of these Terms, it does not waive Seleqt’s right to do so later. These Terms apply to the fullest extent permitted by law, and Seleqt may assign its rights and obligations at any time.


Seleqt is not liable for any loss, damage, delay, or inaction due to causes beyond its control. If any part of these Terms is found to be unlawful or unenforceable, it can be removed without affecting the validity of the remaining Terms. These Terms do not create any partnership, employment, or agency relationship between Seleqt and the Partner. The Partner agrees that these Terms will not be interpreted against Seleqt as the drafter and acknowledges their electronic form and enforceability without a physical signature.


This Agreement is governed by Dutch laws and regulations, and any disputes arising out of or relating to this Agreement will be subject to the exclusive jurisdiction of the courts of The Netherlands.


The Partner agrees to (i) comply with all applicable Dutch laws and regulations in accessing the website and using the Service, including any requirements for emails or LinkedIn messages sent to other countries, and (ii) indemnify Seleqt against any claims, judgments, or losses arising from their non-compliance.
